(1) An accounting officer or accounting authority of a procuring institution commits financial misconduct if that officer or authority fails to take reasonable steps to implement this Act or the procurement system of the procuring institution in accordance with this Act.
(2) A charge of financial misconduct, referred to in subsection (1), must be investigated, heard and disposed of in terms of the statutory or other conditions of appointment or employment applicable to that accounting officer or authority.
